The examination form of Russian trademark application is divided into formal examination and substantive examination. The Intellectual Property Office of the Russian Federation shall examine the application documents, including the legality of the application documents, trademark drawings, power of attorney and other documents; if the requirements are met, the application date and application number will be granted. The notice of the result of the formal examination will be issued within 3-4 months, and the application fee must be paid within 4 months from the date of acceptance of the application; after the formal examination is accepted, it will enter the substantive examination. If the substantive examination stage finds that there is a reason for rejection, the Russian Federal Intellectual Property Office will notify the applicant of the rejection result, and the applicant needs to reply within the specified time. If the reply refutes the reason for rejection, it will be allowed to register. If the applicant's reply is not refuted successfully, the Russian Federation Intellectual Property Office will issue a decision to refuse registration; After the examiner considers that the trademark application can be accepted, he will publish a notice in the Russian official trademark bulletin. During this period, anyone can object to the registration of the trademark application documents. Trademark documents that have been ruled against or have no objection will be approved for registration, the trademark registration certificate is issued to the trademark applicant. Note: (1) The successful registration of a Russian trademark takes about 10-12 months. (2) Chinese trademarks are usually regarded as distinctive in Russia, but they will not be examined as text trademarks but as graphic trademarks. Therefore, elements such as pronunciation and meaning of Chinese trademarks will not be used as elements to judge the similarity of trademarks. (3) The Russian trademark registration process implements the "first registration and then announcement", that is, the post-objection system. If someone intends to oppose the trademark application, it can only be filed after the trademark has been approved for registration. If there is an objection to the trademark in the application, the party concerned may submit a warning letter to the intellectual property office. The warning letter shall state that the trademark shall be subject to relative or absolute grounds and shall not be registered. If the examiner determines that the facts and reasons in the warning letter are established, the trademark application will be rejected after substantive examination.
