2. Review Form

formal examination and substantive examination. After the application is submitted, the application will be subject to formal examination to check whether the documents contained in the application are complete and comply with the requirements, and whether the invention is the object of patent protection. The formal examination is generally completed within three months. If the formal review requirements are met, the application will be published within 18 months from the date of submission of the application. The substantive examination may be conducted at the request of the applicant, but it must be submitted within 3 years from the date of application. After substantive examination, if the application meets the authorization requirements, the application will be granted a patent right. If the NCIP determines that the invention patent application does not meet the requirements, it will make a decision to reject the application. NCIP will notify the applicant of its decision in writing within 5 days of the decision. Applicants have the right to request NCIP to provide copies of objections to their patent applications within 2 months from the date of the NCPI decision. If the applicant is not satisfied with the rejection decision, he/she may request NCIP for review within 4 months from the date on which NCIP makes the rejection decision or NCIP issues a copy of the above objection. The review will take place within 6 months from the date of receipt of the request by NCIP.
