1. A German invention patent application may be filed for priority through the Paris Convention, and the time limit for filing the application is 12 months from the earliest priority date; 2. Entering the German national phase through the PCT channel, the time limit for filing the application is 30 months from the international application date (if priority is claimed, from the earliest priority date); 3. Submit an invention patent application directly to the German Patent and Trademark Office. Invention patent from application to authorization, generally takes 5-8 years.

2. Review Form

DPMA (German Patent and Trademark Office) conducts formal and substantive examination of invention patent applications. After receiving the patent application, the DPMA will conduct a formal examination of the invention patent application and examine whether it is a clear violation of public morality, and classify the patent application according to the international classification standard. 18 months from the filing date/priority date, DPMA completes the patent publication. If a patent application contains information or drawings that are manifestly contrary to public morals, DPMA will avoid the disclosure of the patent application. The applicant shall submit a request for actual examination within 7 years from the date of application/priority at the latest and pay the corresponding examination fee. DPMA will conduct a novelty, industrial applicability and creativity examination of the patent application in accordance with the German Patent Law.
