2. Review Form

Austria implements the substantive examination system for invention patent applications, but it is different from China. The substantive examination procedure is carried out automatically after the application is submitted, without a separate application. It mainly examines whether the novelty, creativity and practicability of the application meet the authorization conditions. Before the substantive examination is carried out, the Austrian Patent Office will first prepare a search report listing the invention patents to be considered in the examination and approval process. Usually within 9 months after the application date, the Patent Office will issue a search report and a notice containing the examiner's opinions. The review process can also be expedited by contacting the reviewers directly in emergency situations. 18 months after the filing date or priority date, together with the search report if it has been published. Objections may be raised within four months of publication.

3. protection period
20 years from the date of application. Patented medicines and new plant protection varieties can be renewed for an additional five years, and children's medicines can be granted an additional six months of patent protection.
